WEBSITE & CUSTOMER PORTAL TERMS · 15 OCTOBER 2026
Clear terms for using our service.
These terms concern the website, enquiries and customer portal of MACGREGOR & O'HANLON ESTATES LTD, company number 17479815, trading as O’Hanlon Estates. The registered office is 10–16 Tiller Road, London, England, E14 8PX.
1. The website and a service agreement are different
The website lets you contact us and, when available, submit a buyer brief or seller information for review. Creating an account, sending a message or submitting a brief does not instruct us to act as your estate agent, appoint us exclusively, authorise marketing of a property, reserve a property, create a tenancy or sale contract, or make a fee payable.
Any paid sourcing, estate agency, introduction, management or other service requires a separate written agreement identifying the parties, work included, exclusions, fees and taxes, when payment is due, duration, termination, complaints arrangements and applicable cancellation rights. We will not begin chargeable work merely because you have used the portal. We will not imply that membership, supervision or authorisation exists while it is pending.
2. Services currently available
The website currently supports enquiries, customer accounts and private buyer/seller briefs. Paid service scope and fees will be set out separately before any instruction is accepted. Property-redress membership and ICO registration are not yet complete, and HMRC supervision status has not been confirmed. We do not claim membership, regulatory approval or readiness to undertake an activity requiring outstanding registration. Submitting a brief does not begin that activity or create a paid appointment.
3. Who can use an account
You must be an adult with authority to provide the information and make the enquiry. If you act for a company or another person, tell us and ensure you are authorised. Use contact details you control. Keep sign-in codes private, sign out of shared devices and tell us promptly if you suspect account misuse. We will not ask you to disclose a sign-in code through an enquiry or to an agent.
4. Your information and submissions
Take reasonable care that information is accurate and current and correct material changes. A seller must have authority to provide details about the property; submission alone is not proof of ownership or permission to publish. Do not include passwords, banking details, identity documents, unrelated personal information or content you are not entitled to provide. The form permits you to review and correct your answers before submission and to reopen saved submissions where available.
A technical receipt means the system accepted the submission; it does not mean we have verified it, agreed to represent you or accepted an offer. If an enquiry fails, retain your message and try again or use the published alternative contact method. An email accepted by the sending provider is not a guarantee of inbox delivery. We will not ask you to pay money solely to correct a technical error.
5. Property information and research
Descriptions, availability, prices, rents, forecasts and research can change and may depend on third-party information. We will take reasonable care in information we provide and will correct material errors brought to our attention. Estimates are not promises of valuation, income, capital growth, return, lending approval or a successful transaction.
Before making a commitment, obtain the legal, survey, financial, tax, planning and other professional advice appropriate to the property and your circumstances. Portal material is not a substitute for a survey, title investigation, lender offer or legal advice. Nothing in these terms removes responsibility for information we are legally required to disclose or for misleading statements.
6. Fees, referrals and independent choice
The portal does not collect client money or take a reservation payment. No fee is agreed by submitting a brief. Any future fee must be explained in the separate agreement, including VAT where applicable and the exact event making the fee payable.
For an optional introduction, we will identify the proposed agent, broker or partner, explain the purpose, disclose any applicable referral fee or relevant financial benefit before your decision, and obtain your agreement to send the necessary contact details. You can decline and choose another provider. An introduction does not guarantee that provider's work, lending decision or availability; that provider's own agreement applies to its service. This does not exclude our responsibility for our own conduct or misleading recommendations.
7. Privacy and communication
Our privacy notice explains processing and your rights. It is not a blanket marketing or partner-sharing consent. Using the website does not subscribe you to marketing. We may contact you to answer your enquiry, operate your account, address security issues or perform an agreed service. Optional marketing must have its own lawful arrangement and a way to stop it.
8. Acceptable use
Do not attempt to access another person's records, bypass security, impersonate someone, upload malware, submit abusive or unlawful content, overload the service or use it for unsolicited advertising. Do not use automated collection of private account data. We may take proportionate measures to prevent misuse and preserve evidence of a genuine security incident.
9. Availability and account restrictions
Maintenance, provider problems and security incidents may interrupt access. We will take reasonable steps to restore it. Keep your own copies of important correspondence and agreements. Unsaved form entries may be lost when a page is closed or refreshed.
We may restrict access where reasonably necessary for security, unlawful use or a serious breach of these terms. Where practicable and lawful, we will explain the reason and provide a way to resolve it. Restrictions must not remove your privacy rights, prevent a legitimate complaint or cancel rights under a separate agreement without its applicable procedure.
10. Content rights
Our branding, layout and original content remain the property of their respective owners. You may view, print and save information for your own legitimate enquiry and service use, including these terms. Do not reproduce it commercially or imply our endorsement without permission. You retain rights in content you supply; you give us only the permission reasonably needed to receive, store and review it and provide an agreed service. This is not an unrestricted right to publish your property or use your information in advertising.
11. Responsibility and your statutory rights
We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill, subject to the law applicable to your circumstances. We do not exclude or limit liability where doing so would be unlawful, including for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Nothing here removes consumer rights or liability under data-protection law. There is no blanket “use at your own risk” waiver or automatic zero-liability cap.
For a business customer, any service-specific allocation of commercial risks must be set out transparently in the separate agreement and remain subject to applicable law. We do not impose an unlimited indemnity merely for using the portal.
12. Cancellation and ending contact
You may stop using the website and ask us to close your account or stop pursuing an enquiry. We will explain any records that must be kept for a lawful reason. Ending portal access does not itself terminate a separate service agreement.
Where a consumer enters a qualifying distance or off-premises service contract, statutory cancellation information and a cancellation form must be supplied before the contract. Where the statutory 14-day right applies, its period, how to exercise it, and any lawful charge for expressly requested early performance must be explained. We will not start work during a cooling-off period or assert that cancellation rights have been lost without satisfying the relevant requirements. These website terms do not replace that contract-specific information.
13. Complaints and disputes
Use Contact us and select Complaint, email ciaran@ohanlon-estates.com, or write to the company address. Include a short description and the outcome you seek; avoid unnecessary sensitive documents. Privacy complaints can use Privacy request or Complaint and can also be raised with the ICO. We will record complaints, investigate fairly and provide a response and any applicable escalation route.
We will provide the relevant verified redress membership and complaints route before undertaking services requiring it. These terms do not require private arbitration or prevent access to a court or regulator.
14. Changes and applicable law
We will identify the version and date of the terms. Changes apply prospectively and will not retrospectively alter an agreed fee, remove an accrued right or change an existing service agreement without a lawful basis. If a provision cannot be enforced, the remainder applies only so far as it can operate fairly and lawfully.
The laws of England and Wales apply to these website terms, subject to any mandatory protections that apply where you live. Consumers retain any right provided by law to bring proceedings in their home jurisdiction. Service agreements will identify the rules applicable to that service.
